Wage and Hour compliance is more important than ever. Both the Colorado Department of Labor and the U.S. Department of Labor are increasing their audits of private employers, while employees are often asserting collective or class actions on wage and hour issues rather than filing individual claims. A variety of wage and hour topics will be discussed, including:
• Colorado’s Wage Act: Permissible Deductions from Wages, and Penalties for Failure to Pay Wages
• Differences between Federal Fair Labor Standards Act and Colorado’s Wage Order 28
• Current issues in FLSA Litigation: Proving an Exemption, Damages, and Settlement
Social Media and Background Checks
Employers want to hire productive members of the workforce, both in terms of work performance and worksite harmony. Employers’ creative efforts to “vet” potential new employees are meeting increased resistance in these times of high unemployment and economic difficulty. Recent legal developments for background checks and social media are impacting hiring processes and potentially limiting employers’ ability to acquire information about prospective employees. We will discuss:
• EEOC’s new guidance on criminal background checks
• Colorado’s recent efforts to curb use of credit information in employment
• Employment status as new “protected class?”
• Social media access as condition of employment
